On the following pages you will find the general terms and conditions ("GTC") for your registration and orders in the online shop of EBCADE KG, Vienna (hereinafter also "Homidea"), under the Internet domain www.homidea.co.uk (hereinafter "Homidea").
Legislators especially oblige online providers to provide numerous information about the contract and the applicable conditions. We have compiled this information and our other shipping conditions for you below. Unless otherwise stated in the product description, the articles offered by Homidea are designed for private use. If you have any questions about increased requirements for use in your business, our customer service will be happy to help.
1. Scope; Deadlines
1.1 The business transaction and delivery takes place exclusively in accordance with the present terms and conditions, which are the basis of all contracts concluded based on the offers on Homidea. General terms and conditions that contradict or deviate from the following provisions do not apply.
1.2 Insofar as these terms and conditions refer to "consumers", these are natural persons who conclude a legal transaction for purposes that are not part of the operation of their company. “Entrepreneurs”, on the other hand, are natural or legal persons or partnerships with legal capacity, for which the business belongs to the operation of their company. The distinction between consumers and entrepreneurs is made in the sense of the Austrian andU.K. Consumer Protection Act (KschG). “Customers” in the sense of these terms and conditions are both consumers and entrepreneurs.
1.3 If working days are specified as deadlines, this includes all weekdays with the exception of Saturdays, Sundays and national public holidays.
2. Registration at www.homidea.co.uk
2.1 When ordering goods and / or creating a customer account on Homidea you will be asked to register and provide your personal data.
2.2 When entering your personal data required for registration, you are responsible for providing truthful and complete information. You are obliged to treat the personal access data confidentially and not to make it accessible to unauthorized third parties. The registration is confirmed immediately after sending the registration.
2.3 You are solely responsible for content that you post in areas accessible for this purpose. These must not violate the rights of third parties. There is no entitlement to storage or publication of your posted content, such as product reviews.
2.4 You must refrain from any disruption to the Homidea website or further use of the accessible data outside of the intended use within the platform. Manipulations that have been proven to achieve unauthorized payments or other advantages to the detriment of Homidea or other parties can, in addition to legal consequences, in particular also lead to loss of access to Homidea. Customers are entitled to use the online offer within the scope of the respective availability. The content may only be used for private, non-commercial purposes.
2.5 Each customer is only entitled to maintain a customer account. We reserve the right to delete multiple registrations, to warn customers who violate the provisions mentioned in sections 2.1 to 2.4 or to delete or change content (virtual house rights).
2.6 There is no entitlement to permanent accessibility to the website or access to the data or other services offered. Homidea also does not guarantee that the platform or parts of the services are always available.
2.7 For logistical and technical reasons, shopping via guest access at Homidea is currently not possible.
3. Order process; Correction options; Possibility to save and view contract text
3.1 We made the order process technically very easy for you. Select items from the offers on Homidea and determine the desired number of items to order. You prepare the order for a selected item by saving it in the shopping cart by clicking the "Add to cart" button. You can now return to the catalog view using the "Continue shopping" button and select additional items and add them to the shopping cart as described. To continue ordering the selected items, click the "Go to shopping cart" button.
3.2 In the shopping cart you can check and correct the number of selected items again or remove individual items from the shopping cart or buy additional items using the "Continue shopping" button. By clicking on the "Proceed to checkout" button, you will be taken in further steps to call up your existing registration or to enter your data. You (i) can then specify a different delivery address, (ii) are requested to accept these general terms and conditions, the applicable cancellation policy and the applicable data protection declarations and notices, (iii) can choose one of the payment options offered to you and (iv) before When sending the order, check your details in peace and correct them if necessary. At this point you can save or print the completed order with the function of your browser. The order is only legally binding when you click the "Buy" button.
3.3 You can view these terms and conditions on the Homidea shop page under "Terms and Conditions". You can also print out or save this document using the usual function of your Internet service program (= browser: usually "File" + "Save as") and download and archive it in PDF form.
3.4 The contract text is saved. The text of the contract cannot be called up separately later. However, you can print out or save the contract text before sending it. You can also simply archive the data of your order by either (i) downloading the terms and conditions and saving the data summarized on the last page of the order process in the online shop using the functions of your browser or (ii) waiting for the automatic order confirmation that we receive Send them to you by email to the email address you provided. This email contains the data of your order again and can be easily printed out or saved with your email program.
3.5 Your order data will be saved by us, but for security reasons you will not be able to call it up immediately. 4.2 If you choose the payment method prepayment, the purchase price is due for payment immediately. You will receive the transfer data immediately after receiving your order.
4.3 In the case of a credit card purchase, a (pre-authorized) reservation of the amount is made when the order is completed. Your credit card account will be debited promptly after the order has been completed.
4.4 If you choose to pay via PayPal, you pay the invoice amount via the online provider PayPal (Europe) S.à rl & Cie, SCA, 5th floor, 22-24 Boulevard Royal, 2449 Luxembourg (hereinafter "PayPal" ). You must be registered with PayPal or register first. You will be directed to the PayPal website during the ordering process, where you can legitimize yourself with your access data and confirm the payment instruction to us. In this case, the purchase price is due for payment immediately.
4.5 Please note that we only accept payments from accounts within the European Union (EU). Under no circumstances do we assume the costs of a money transaction.
4.6 Homidea reserves the right to send any invoices to customers only in electronic form (currently via email).
5. language; Conclusion of contract
5.1 Contracts regarding articles that are offered on Homidea can only be concluded in english.
5.2 The presentation of the products in our online shop does not constitute a legally binding offer, but only a non-binding online catalog. By clicking the "Buy" button you are making a binding offer to purchase the items in the shopping cart.
5.3 Confirmation of the technical receipt of your order follows immediately after we have received the order via email to the email address you have provided. This confirmation of receipt does not yet constitute acceptance of your order.
5.4 A binding contract for the purchase of the items included in your order is concluded when your order is accepted. The acceptance can be made by the following circumstances: (i) For orders with the payment method prepayment with our request to you for payment. (ii) For orders with the payment method PayPal or credit card with completion of your order. (iii) For all other orders with receipt of a separate declaration of acceptance by us by email
5.5 The customer is bound to his respective order for 5 working days. When ordering furniture that Homidea does not have in stock, the clarification of the order can be more time-consuming. Here the customer is bound to his order for the delivery time specified in the offer.
6. Prices; Shipping; Additional services
6.1 The prices listed in the offer at the time of the order apply. The prices quoted are final prices, which means that they include the applicable Austrian VAT and other price components.
6.2 We take over the shipping costs for all deliveries within U.K. for you. Our deliveries are made on working days between 7 a.m. and 6 p.m.
6.3 Special additional services (such as Saturday delivery, late delivery 6:00 p.m. - 8:00 p.m. and delivery in the preferred time window in the morning / afternoon) are possible for some items (only for deliveries by furniture forwarding agents) and can be booked for a fee if the delivery is notified by telephone.
7. delivery times; Delay; Delivery area
7.1 The delivery time is extended appropriately in the event of circumstances that impair delivery due to force majeure. Force majeure equates to strikes, lockouts, official interventions, energy and raw material shortages, no-fault transport bottlenecks, non-faulty operational disabilities, for example due to fire, water and machine damage, and all other disabilities that, from an objective point of view, have not been caused by us. You will be informed of the start and end of such obstacles immediately.
7.2 If it has been agreed that the customer will further specify his order to Homidea, for example in terms of dimensions, design or model, and that the customer has exceeded the deadline agreed for the specification, the resulting delay in delivery will not be borne by Homidea. The right is reserved to completely or partially delete the order that is not specified in time.
7.3 If the customer is in arrears with a payment obligation, all claims against Homidea against this customer are due.
7.4 The dispatch of Homidea articles is basically free of charge for you. Homidea items for which delivery is stated as 'free to use' in the shipping information will be delivered by the commissioned shipping company to the place in your home where the furniture should be. The delivery presupposes that the delivery address can be reached via routes that can be driven by trucks and - if ´free place of use´ is delivered the delivery (e.g. through entrances and stairwells) can be carried out to the apartment using the usual means of furniture transport. Please check the article dimensions. If a corresponding route or barrier-free access is not secured or if you have any doubts, please contact our customer service before ordering, but at the latest before shipping. In this case, Homidea will only deliver the article to the point that is accessible; Pre-assembled items cannot be disassembled upon delivery.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.

Withdrawal due to damaged or defective products
If you have received a damaged or defective product, please contact us immediately; the product must not be assembled with damaged or defective parts.
We kindly ask you to send us some photos of damaged or defective parts and the packaging so that we can clearly see whether this damage was caused by transport or production. This is very important to us because we have exactly 14 days to report the damage.
And if there are defects; Incorrectly drilled mounting holes, insufficient finishing, etc. We inform our production that we can take improvement steps according to our quality standards.
As soon as we have the photos of you, we order the collection of the product from your address and the product can be picked up within 1-3 working days.
We will refund your money to your account as soon as the product is picked up from your address.
For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.
Withdrawal without reason or any other reason
If you want to return the product without reason or for reasons that are not related to damage or defects, such as ordered by mistake, no longer required, unexpected quality, wrong product ordered, etc. We can offer you our flat rates for returning the product.

If you agree with our all-inclusive prices, please let us know briefly that we can order the collection of the product from your address.
If you would like to organize the return of the product yourself, please let us know the tracking details.
We can refuse the repayment until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier, you have the goods immediately and in any case within fourteen days at the latest to be returned or handed over to us from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send off the goods before the period of fourteen days has expired.
You will bear the direct costs of the return.You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the nature, properties and functioning of the goods.
End of cancellation notice
Exclusion or premature expiry of the right of withdrawal:
The right of withdrawal does not exist for contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer.
General information
Please avoid damage and contamination of the product. If possible, send the goods back to us in their original packaging with all accessories and all packaging components. We only accept the return of the products in their original packaging. If the original packaging is no longer usable due to transport damage, please let us know before you send the product back.
8.2 Unless you provide us with any other account details, the repayment will always be made to the account you used for payment.
9. Additional voluntary right of return up to 30 days after receipt of the goods
9.1 In addition to the statutory right of withdrawal, we grant you a voluntary right of return for all purchases at Homidea for a total of 30 days from receipt of the goods. 9.2 Unless you provide us with any other account details, the repayment will always be made to the account you used for payment.
9.3 The statutory right of withdrawal (see Section 8.1) is not affected by compliance with our rules on the supplementary contractually granted (voluntary) right of return and remains independent of this. Until the expiry of the period for the statutory right of withdrawal, only the legal conditions listed there apply. The contractually granted voluntary additional right of return also does not limit your statutory warranty rights, which you retain without restriction. Homidea expressly reserves the right to exclude the voluntary right of return for special promotions in the respective conditions of participation.
10. Retention of title; Resale
10.1 The delivered goods remain the property of Homidea until the purchase price has been paid in full.
10.2 The following also applies in commercial business: The goods may only be sold by the buyer in the ordinary course of business. We reserve the right to revoke the above consent to the resale of the goods delivered under retention of title, to withdraw from the contract in the event of a delay in payment and to demand the return of the goods. Claims from the resale of goods subject to retention of title have been assigned to us to secure our claims. You must inform us immediately in the event of a seizure of goods subject to retention of title. We undertake to release the securities to which we are entitled at your request insofar as the value of our securities exceeds the claim to be secured by more than 10%.
11. Promotional vouchers
11.1 Homidea offers promotional vouchers. Promotional vouchers are vouchers that you cannot purchase, but are issued as part of advertising campaigns with a specific validity period.
11.2 Promotional vouchers are only valid for the specified period and can only be redeemed once during an order process at Homidea. Individual brands or individual articles can be excluded from the voucher campaign.
11.3 The value of the goods must at least correspond to the amount of the promotional voucher. For administrative reasons it is not possible to refund any remaining credit.
11.4 You can use the button to redeem the voucher by entering the voucher code in the shopping cart, but only before completing the order process. Subsequent offsetting is not possible. The credit of a promotional voucher is neither paid out in cash nor interest.
11.5 The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined.
11.6 If the credit of a promotional voucher is not sufficient for the order, the difference can be compensated with the payment options offered.
11.7 The promotional voucher will not be reimbursed if goods are returned in whole or in part, provided that the promotional voucher has been issued as part of a promotion and no consideration has been paid.
11.8 Information on the applicable terms and conditions and the redeemability of the vouchers with regard to our various sales models can be found in the respective vouchers themselves.

13.1 Gift vouchers (vouchers that you can purchase) can be redeemed for the purchase of articles on Homidea.
13.2 The credit of a gift voucher is neither paid out in cash nor interest.
13.3 Gift vouchers can only be redeemed before the order process is completed. Subsequent offsetting is not possible.
13.4 If the credit of a gift voucher is not sufficient for the order, the difference can be compensated with the payment options offered.
13.5 More than one gift voucher can be used for an order.
13.6 We assume no liability if the voucher code is lost. We also accept no liability for typographical errors in the voucher recipient's email address.
13.7 The gift voucher is transferable. Duplication, editing or manipulation of the vouchers is not permitted.
13.8 The voucher code will be sent via email after receipt of payment.
14. Applicable law
14.1 The applicability of the law of the Republic of Austria to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is agreed with consumers.
14.2 In business dealings with traders, entrepreneurs, legal entities under public and private law and other persons who are not consumers, the applicability of the law of the Republic of Austria to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG ) agreed. In this case, the courts in Vienna are solely responsible for all legal disputes arising from or in connection with this contract, whereby Homidea is entitled to sue at the customer's registered office.
15. Severability clause
Should individual provisions of the contract, including these provisions, be or become ineffective in whole or in part, or should the contract have an unforeseen gap, the effectiveness of the remaining provisions or parts of such provisions remains unaffected. The respective statutory regulations take the place of the ineffective or missing provisions.
